About Us

I earned my general law degree (JD) from the University of Kentucky College of Law and I obtained an advanced law degree, a Masters of Law (LL.M) in Taxation, from New York University School of Law. I was also an Accounting major. I practice law in Kentucky and my personal cell phone number is 502-649-4788. I do not make promises about results (e.g. ‘settle for pennies on the dollar’ sales pitch), but I will promise to zealously represent your interests and charge your fairly if you hire me.

There is a misconception that non-attorneys (e.g. the tax resolution firms or “enrolled agents” that advertise on TV) are cheaper than licensed attorneys. However, the truth of the matter is that we licensed attorneys are heavily regulated by the Kentucky Bar Association and cannot charge an unreasonable fee. I have reviewed many non-attorney contracts related to tax issues. Typically the fee charged by non-attorneys is greater than that charged by me. There are a number of reasons why, but it is mostly related to the fact that they are very good at sales and typically are unregulated, except for Circular 230. Do you really want to sign a Form 2848 Power of Attorney giving authority to a non-attorney located out-of-state to represent you? What about your State tax issues?

As an attorney I can analyze and represent you regarding all of your legal options, including foreclosure defense and bankruptcy protection. I am authorized to practice in Kentucky District and Circuit Courts, the United States Federal District Court, United States Tax Court and the United States Bankruptcy Court . The ability to bring the matter to court places pressure on the government and increases the odds of success. Bankruptcy of eligible taxes is often the best financial option in the end and it’s interplay with other options is very important to understand. Additionally, it is only with an attorney that the taxpayer is able to fully protect his or her “attorney-client privilege”. Finally, I can help you with tax matters with the Kentucky Department of Revenue.

My email address is law@darbysmithlaw.com. Of course, you can call me on my cell phone. Perhaps we could arrange a 30-minute face-to-face consultation that won’t cost you anything if you do not choose to hire me. I can email me you a copy of my Retainer Agreement if you want to see it beforehand.

My office is located in Norton Commons which is in northeast Louisville off the Gene Snyder (“Crestwood Exit”) before it intersects with I-71. There is plenty of parking so you don’t have to deal with downtown traffic. Please note that there are many time sensitive deadlines in the tax code so its best that you call me before any expire. If you are located outside of Louisville, I can easily help you without having to meet in person, provided you have access to the internet. I look forward to helping you with your tax matter.
